These Terms govern streakerpools.com, app.streakerpools.com, api.streakerpools.com, and the related Streaker Pools service (collectively, the “Service”). Streaker Pools is the brand name of the product we offer. The Privacy Policy describes how we handle personal information. If you do not agree to these Terms, do not use the Service.
1. The Service
Streaker Pools provides software for hosting and managing NFL pools. The Service includes pool setup, invitations, pick submission, scoring tools, standings, and related notifications for the Streaker and Parlay Streaker games.
The commissioner for a pool is the person who pays Streaker Pools to host it. Players do not pay us to join or use a pool.
We provide software and hosting. We do not collect, hold, transfer, calculate, or distribute participant contributions, prizes, or other off-platform funds. Any arrangement among people in a pool about money or prizes is outside the Service, solely between those people, and the responsibility of the people who make it. We do not see, administer, validate, or referee that arrangement. A commissioner should not invite anyone into an off-platform arrangement unless every person involved can legally enter it.
Scores, points, lives, streaks, and similar records in the Service have no cash value. We do not redeem them for money, prizes, or anything else of value.
2. Eligibility
The Service is offered only in the United States at launch. You may not create an account or play unless you are at least 13 years old. Only a person who is 18 or older and able to enter a binding contract may create a pool or purchase hosting. Ages 13–17 may join any pool.
Signup uses a neutral date-of-birth screen to determine eligibility before an account is created. If the submitted age is under 13, signup is rejected, no account is created, and the submitted signup information is not retained. We store an age range for an accepted account (13–17 or 18+), not the full date of birth. If we confirm that an account was created for someone under 13, we will close the account and delete its account information, except information we must keep for security, fraud prevention, legal compliance, or dispute handling.
If you are under 18, or invite someone who may be under 18, do not make an off-platform agreement unless every person involved can legally make that agreement.
3. Accounts and pool information
You must provide accurate information and keep your sign-in credentials secure. An account uses an email address, a required public display name or handle, an age range, and a record of the Terms and Privacy versions you accepted. We do not collect first or last names for your account. You are responsible for activity under your account and for keeping your contact information current.
Commissioners can see the information needed to administer their pools, such as a player’s display name, email address used to join, picks, and standings. Other people in a pool may see display names, picks, messages, and standings according to that pool’s settings. Do not share information in a pool that you would not want the commissioner and other participants to see.
You keep rights in names, messages, picks, and other content you submit. You give us a limited license to store, display, and process that content as needed to operate, secure, support, and improve the Service, including showing pool information to the people entitled to see it in that pool.
4. Acceptable use and suspension
You may not:
- scrape, overload, probe, or interfere with the Service or its security;
- use the Service for unlawful activity or to operate a pool in violation of applicable law;
- harass, threaten, defame, or impersonate another person;
- misrepresent your age, identity, or location;
- upload content that is unlawful, infringing, or malicious; or
- resell the Service or use another person’s pool information outside the needs of running that pool and applicable law.
We may limit, suspend, or close an account or pool for a violation of these Terms, suspected fraud or abuse, a security risk, a legal requirement, or an operational need. We will take reasonable account of the circumstances and the information available to us. A suspension or closure does not erase obligations that should continue, including obligations concerning payment disputes, user content, liability, or off-platform arrangements.
5. Hosting fees and refunds
Hosting fees are one-time software fees paid by the commissioner through Stripe Checkout. They pay for Streaker Pools hosting and features; they are not a participant contribution or a share of any pool prize. Prices and applicable taxes are shown before payment.
The first hosted week is a limited trial period of the software. You may request a full refund up until the scheduled kickoff time of the first NFL game of the second week of your pool.
| Situation | Refund treatment |
|---|---|
| Before that kickoff | Full refund through the commissioner’s refund control, when that control is available |
| After that kickoff | No refund, because the pool has had its first hosted week |
| We accept payment but fail to provision the pool | Full automatic refund |
| Duplicate payment for the same pool | Refund of the duplicate payment after contacting [email protected] |
| NFL disruption, postponed or cancelled games, an interrupted season, or another event outside our control | No refund under this policy |
| Suspension caused by a violation of these Terms | No refund |
A pool that starts in week 1 may be refunded through week 1, before the first game of week 2. A pool that starts in week 5 may be refunded before the first game of week 6. When we issue a refund, it is sent to the original payment method through Stripe. A refund, chargeback, or payment dispute may cancel or suspend the related pool and account while we investigate it.
6. Game data, schedules, and availability
Schedules, kickoff times, scores, and other game data may come from third parties. We update the Service on a best-effort basis, but data may be delayed, incorrect, unavailable, or later revised. We do not promise that a schedule, score, pick deadline, standings result, or other game record will always be complete or final at a particular time.
The Service may be unavailable or interrupted because of maintenance, traffic, vendor failures, network problems, weather, game changes, or other events outside our reasonable control. We will use reasonable efforts to restore service, but we are not responsible for a missed pick, standings change, or other consequence caused by an interruption or data error.
Streaker Pools is not affiliated with, endorsed by, or sponsored by the National Football League, any NFL club, or NFL Properties. Team and player names are used only to identify games and belong to their respective owners.
7. Our software and your license
The Service, including its software, design, copy, and Streaker Pools marks, belongs to Enduring Technologies, LLC or its licensors. Subject to these Terms, we give you a limited, personal, non-exclusive, non-transferable license to use the Service for your own pool-management and participation purposes. You may not copy, reverse engineer, modify, sublicense, or build a competing service from the Service except to the extent a restriction cannot legally apply.
8. Changes to the Service or Terms
We may change the Service and these Terms. Each published Terms version has its own version identifier and effective date. We will communicate material changes in a manner appropriate to the change, such as an updated legal page, email, or an in-product notice. Continued use after a new version becomes effective means you accept the new version; if you do not accept it, stop using the Service.
At signup, we record the exact Terms and Privacy versions you accepted and the time of acceptance. Publishing a later version does not overwrite the text or acceptance record for an earlier version. We keep each published version so an acceptance can be matched to the text in effect when it was recorded.
9. Informal notices and disputes
Before starting a court claim about the Service, please send an informal dispute notice to [email protected] with the email on your account and a description of the issue. We will try in good faith to resolve the issue through that mailbox. A user may also bring an eligible matter in small-claims court.
Texas law governs these Terms, except to the extent another law cannot be waived or requires a different rule. For disputes that are not eligible for small claims, each party consents to the jurisdiction of the state or federal courts located in Texas, subject to any venue rights that applicable law gives a consumer. Nothing in these Terms prevents a person from exercising a right that cannot legally be waived.
10. Disclaimers and limits
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” TO THE FULLEST EXTENT PERMITTED BY LAW. WE DISCLAIM WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT PROMISE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR AVAILABLE IN EVERY LOCATION.
TO THE FULLEST EXTENT PERMITTED BY LAW, ENDURING TECHNOLOGIES, LLC AND ITS MEMBERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, GOODWILL, OR SUBSTITUTE SERVICES, ARISING FROM THE SERVICE OR THESE TERMS.
OUR TOTAL LIABILITY FOR A CLAIM ARISING FROM THE SERVICE IS LIMITED TO THE HOSTING FEES YOU PAID US FOR THE AFFECTED POOL, OR $0 IF YOU PAID NOTHING. WE ARE NOT LIABLE FOR AN OFF-PLATFORM CONTRIBUTION, PRIZE, OR ARRANGEMENT. Some jurisdictions do not allow every exclusion or limitation, so a limitation applies only to the maximum extent permitted by law.
You agree to reimburse and defend Streaker Pools and its members, officers, employees, and agents against a third-party claim arising from your unlawful use of the Service, your content, or an off-platform arrangement you organize, except to the extent the claim was caused by our own misconduct. We will give notice of a covered claim when reasonably practicable and may participate in its defense.
11. General terms
These Terms and the Privacy Policy are the complete agreement about the Service. If a court finds a provision unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them as part of a reorganization, financing, or sale of the business. Provisions that by their nature should continue after termination do continue, including payment obligations, ownership, content license, disclaimers, limits, and dispute terms.
We may send account, security, legal, and pool-operation messages. Optional marketing messages include an unsubscribe mechanism. You may ask questions, submit privacy requests, send an informal dispute notice, or voluntarily report suspected misuse to [email protected]. Reporting suspected misuse is encouraged but is not a contractual duty.
